Home Medical Equipment Warranties |

Licensed providers of Home Medical Equipment in Florida are required to honor all warranties expressed and implied under applicable state law (s. 400.934(9), Florida statutes.) Those warranties include assistive technology devices as defined in s. 427.802(1), Florida statutes. (See also chapter 59A-25.003(f), Florida Administrative Code.) The warranty period extends for one year from the date of delivery for new home medical equipment or assistive technology devices and thirty days from the date of delivery for used equipment.
If you have experienced a problem with a defective or substandard assistive technology device or home medical equipment, you should take the following steps:
- First, contact the dealer or manufacturer the device was purchased from and explain your problem.
- The dealer or manufacturer should offer to resolve the problem by either repairing or replacing the defective product.
- The warranty period for home medical equipment or assistive technology devices is one year from the date of delivery for new equipment and thirty days from the date of delivery for used equipment.
- If you cannot resolve the problem with the dealer or manufacturer, you can file a complaint with the Agency for Health Care Administration (AHCA) by calling their toll-free intake number at 1-888-419-3456.
- Provide the intake person at AHCA with a brief description of your complaint. Your complaint will be referred to the appropriate person within AHCA.
- An AHCA representative should call you back and provide assistance in resolving your complaint with the dealer or manufacturer.
- If you are unable to resolve your complaint with ACHA, you call the FAAST headquarters at 850-487-3278 and the FAAST staff will assist you in seeking a resolution to your problem.
